In May 1999, the EEOC's Miami office filed this suit in the U.S. District Court for the Middle District of Florida against Mid-State Machine and Fabricating Corporation alleging specific and general violations of the Americans with Disabilities Act of 1990. Specifically, the EEOC alleged that the defendant had unlawfully denied employment opportunities to the complainant based on a perceived disability gleaned from a prohibited pre-employment medical examination. The EEOC also alleged that several of the defendant's job descriptions were created in violation of the ADA in that they did not accurately reflect the physical requirements of the specific jobs.

After some delays and postponed trial dates, and a mediation conference, the parties were able to agree on a consent decree which was adopted by the court in April 2001. The defendant was ordered to pay nearly $20,000 to the charging party and two other complainants and was required to amend their job descriptions, create ADA training programs, post notice of equal employment opportunity rights and amend the process by which they evaluated and rejected applicants including granting a right to applicants to appeal a denial based on a physical limitation.
