In September 2006, the Phoenix District Office of the EEOC filed this suit against Medegen Medical Products, LLC, a manufacturer and marketer of medical products in the U.S. District Court for the District of Colorado. The complaint alleges multiple violations of the Age Discrimination in Employment Act (ADEA). The EEOC alleged that the defendant's reduction in force (RIF) scheme targeted at individuals at or above the age of 40. The EEOC alleged further that the eliminated positions and duties that led to the RIF were assumed by younger employees or advertised as vacant in local newspapers. After less than a month the parties stipulated to a motion for dismissal pursuant to a settlement agreement.

The settlement agreement states that its terms shall be limited to an 18-month limitation on enforceability. The agreement states that Medegen will (1) pay all possible claimants a total of $574,595.61 in satisfaction of all claims related to this litigation; (2) pay six named individual $75,286.20 each; (3) pay two named individuals $9,189.60 each; (4) provide each affected individual with a neutral reference letter and a plaque recognizing each individual's years of service; (5) not engage in any discrimination or retaliation in violation of the ADEA; (6) post comprehensive EEO Policy posters stating that it prohibits all forms of discrimination; (7) provide notices to all new employees of its commitment to nondiscriminatory operation; (8) train all managerial personnel and human resources in the affects and investigation of age discrimination; (9) obtain Spanish translations of its current handbook for all non-English speaking employees; and (10) report any internal complaint it receives to the EEOC, along with the names of the individuals involved, persons assigned to investigate, and a brief summary of the complaint. The docket sheet doesn't show show any further enforcement took place; the case was presumably closed in 2008.
