In September 2004, the Los Angeles District Office of the EEOC brought this suit against Riviera Operating Corporation, d/b/a Riviera Hotel and Casino, in the U.S. District Court for the District of Nevada alleging that the defendant violated Title VII of the Civil Rights Act of 1964 and the Age Discrimination in Employment Act of 1967 by retaliating against the two charging parties because of their participation as witnesses in an EEOC investigation of alleged sex and age discrimination by the…

In September 2004, the Los Angeles District Office of the EEOC brought this suit against Riviera Operating Corporation, d/b/a Riviera Hotel and Casino, in the U.S. District Court for the District of Nevada alleging that the defendant violated Title VII of the Civil Rights Act of 1964 and the Age Discrimination in Employment Act of 1967 by retaliating against the two charging parties because of their participation as witnesses in an EEOC investigation of alleged sex and age discrimination by the defendant against another employee. The retaliation consisted of unnecessary discipline, termination, and refusal to rehire. The two charging parties intervened in the suit in May 2005. About a month later the defendant filed a partial motion to dismiss which was granted in September 2005. After some discovery, the defendant filed a motion for summary judgment in June. The defendant's motion was granted in part and denied in part in October 2006. In March 2007, the parties participated in a settlement conference, resulting in a settlement. The plaintiffs agreed to accept the defendant's offer of judgment in the amount of $40,000, to be distributed between the two charging parties.
