In September 2005, the Milwaukee District Office of the EEOC brought this suit against the Humane Animal Welfare Society in the U.S. District Court for the Eastern District of Wisconsin alleging violation of the Age Discrimination in Employment Act ("ADEA"). Specifically, the charging parties, former employees, alleged that the defendant terminated their employment because of their age and then refused to rehire them in retaliation for their complaint to the EEOC. In January 2006, the parties participated in mediation, and they reached a settlement through a consent decree in February 2006.

The eighteen-month decree contained a non-retaliation clause and required the defendant to pay a total of $25,000. In addition, the defendant agreed to: provide ADEA training to managers and supervisors, post an EEOC-provided notice, provide neutral references for the charging parties, report to the EEOC at specified intervals, and provide the charging parties with a letter of regret.

The decree was entered in 2006 and scheduled to last 2007. No further docket entries exist, so the case is closed.
