The Seattle District Office of the EEOC brought this action in the U.S. District Court for the Western District of Washington, against American Seafoods Company. The complaint, filed in September 1999, alleged national origin discrimination in violation of Title VII of the Civil Rights Act of 1964; specifically that Defendant subjected the charging parties to harassment and other discriminatory practices based on their national origin, Hispanic. In November 2000 the parties settled the case, and a consent decree was entered.
The decree, valid for two years, required Defendant to pay a total of $320,000 ($300,000 to the charging parties and $20,000 to a class of Hispanic workers), and expunge the charging parties employment records. Defendant was enjoined from discriminating or retaliating in violation of Title VII and required to post a notice of non-discrimination at its facility, provide Title VII training to its employees, translate is Employee Handbook EEO provisions into multiple languages, amend its anti-discrimination policy, appoint a in house Consent Decree Administrator, and report regularly to the EEOC about its compliance with the decree.
