On September 13, 2006, the Equal Employment Opportunity Commission ("EEOC"), on behalf of female employees, filed a lawsuit in the Eastern District Court of California, under Title VII of the Civil Rights Act of 1964, as amended by Title I of the Civil Rights Act of 1991, against California Psychiatric Transitions, Inc. The EEOC sought injunctive relief, compensatory damages, punitive damages, attorneys' fees, and other forms of affirmative relief claiming that the defendant subjected female employees to a sexually hostile work environment and/or constructively discharged some female employees in retaliation for engaging in protected activity under Title VII.

On July 31, 2009, the District Court (Judge Oliver W. Wanger) denied the defendant's motion for summary judgment regarding the plaintiff's prima facie case. On August 12, 2009, the District Court (Judge Wanger) granted the plaintiff's motion for partial summary judgment regarding satisfying the conditions precedent for a Title VII sexual harassment claim and also granted the defendant's motion for partial summary judgment regarding the plaintiff's failure to satisfy the conditions precedent for a Title VII constructive discharge claim.

On October 21, 2009, the District Court (Judge Oliver W. Wanger) entered a consent decree where the defendant, among other things, agreed to pay the female employees $145,000.
