On March 30, 2001, the U.S. Equal Employment Opportunity Commission filed this lawsuit against A & A Ready Mixed Concrete Inc. in the U.S. District Court for the District of Central California. The EEOC alleged that the defendant racially discriminated against the charging party in violation of Title VII of the Civil Rights Act. The charging party claimed he was fired for complaining about a racial slur used against him by his coworker. The complaint is not available.

On May 21, 2001, the parties entered into a consent decree that required the defendant to not retaliate against any employee for reporting discrimination, to implement an anti-discrimination training program for employees, and to pay $67,400 in monetary relief. The consent decree was court enforceable for a two-year period. The consent decree ran its course without any further litigation and the case is now closed.
