In December 2005, the Memphis Office of the EEOC brought this suit against Papa John's USA, Inc. in the U.S. District Court for the Middle District of Tennessee alleging discrimination on the basis of disability in violation of Title I of the Americans with Disabilities Act of 1990. Specifically, the complaint alleged that the defendant failed to hire the claiming party because of his disability following the district supervisor's order not to hire claimant. The charging party intervened in the suit in December 2005. After one settlement conference, the parties settled the lawsuit in December 2006 through a consent decree.
The one-year decree, containing non-discrimination and non-retaliation clauses, required the defendant to: post its anti-retaliation policy, provide anti-discrimination training for all managers engaged in hiring practices, and pay $36,000 to complainant.
The decree was entered in 2006 and scheduled to last 2007. No further docket entries exist, so the case is closed.
