The Little Rock office of the EEOC brought this action in the U.S. District for the Eastern District of Arkansas, against Hargis-Caldwell Partners, LLC d/b/a Huddle House of Clinton. The complaint, filed in July 2006, alleged sex discrimination in violation of Title VII of the Civil Rights Act of 1964; specifically that Defendant reduced the charging parties hours and then terminated her because of her pregnancy.

In April 2007, the parties entered into a consent decree. The decree was valid for one year and required Defendant to pay charging party a total of $20,000 ($9.921.84 in back pay and $10,078.16 in damages and expunge her personnel records of any unfavorable comments. Defendant was also prohibited from discriminating or retaliating in violation of federal anti-discrimination laws, and required to post a non-discrimination notice, provide EEO training to its managers and supervisors and distribute its policy regarding pregnancy to its employees. The docket sheet shows that no further enforcement took place; the case was presumably closed in 2008.
