On September 30, 2003, the Memphis office of the Equal Employment Opportunity Commission filed a lawsuit under Title VII and the Age Discrimination in Employment Act in the U.S. District Court for the Middle District of Tennessee against the Indiana Insurance Company. The EEOC alleged that the defendant, who was operating as a division of Liberty Mutual Insurance Company in Nashville, Tennessee, had violated the complaintant's constitutional rights by discriminating against him on the basis of his age and race. More specifically, the EEOC claimed that the defendants had violated the complainant's rights by failing to promote him, choosing instead to promote a younger, white employee who was less qualified for the position at issue.

On December 1, 2004, the parties reached a settlement, which the district court adopted as a consent decree on December 30, 2004. Under the terms of the decree, the defendants were enjoined for three years from discriminating or retaliating against any employee on the basis of their age or race. In addition, the defendants agreed to pay $178,065 to the complaintant, a sum which included $156,993 in damages and $21,072 in backpay, interest, and accrued vacation pay. Since we have only the docket in this case, we have no further information on the terms of the settlement. Since the three years has passed without additional activity on the docket, the case is closed.
