On September 29, 2006, the Equal Employment Opportunity Commission ("EEOC"), on behalf of a black applicant, filed a lawsuit in the Western District Court of Texas, under Title VII of the Civil Rights Act of 1964, as amended, and Title I of the Civil Rights Act of 1991, as amended, against Brown Group Retail, Inc. The EEOC sought instatement of the applicant, injunctive relief, compensatory damages, punitive damages, attorneys' fees, and other forms of affirmative relief claiming that the defendant refused to hire or even allow the applicant to obtain an application for the job because of her race, black.
On July 27, 2007, the District Court (Judge Vanessa D. Gilmore) entered a consent decree where the defendant, among other things, agreed to pay the complainant $8,500.
