EEOC alleged on behalf of a female complainant that the defendant refused to hire her at the North Little Rock, AR facility because of her sex. The complainant did not intervene in the EEOC lawsuit or file a separate suit.

The defendant filed a motion for partial summary judgment on 03/22/2006. The district court did not have a chance to decide on the motion because the parties settled after a settlement conference held before Magistrate Judge H. David Young on 04/18/2006. The court entered a consent decree on 04/25/2006.

Under the consent decree, the defendant would pay the individual complainant $29,000 in damages. The defendant was required to provide training on sex discrimination and retaliation for its hiring officials, supervisors, and managers at the North Little Rock, AR facility; the defendant was also required to post a notice for one year within 10 days after the entry of the consent decree. The docket sheet shows that no further enforcement took place; the case was presumably closed in 2009.
