Case Summary

The Detroit District Office of the EEOC brought this action in the U.S. District Court for the Western District of Michigan, against Johnson Controls, Inc. The complaint, filed in February 2003, alleged discrimination in violation of the Americans with Disabilities Act of 1990 (ADA), specifically that Defendant failed to reasonably accommodate the charging party and terminated his employment based on his disability, kidney failure.

In March 2004 the parties entered into a consent decree. The decree, valid for two years, required Defendant to pay charging party $55,000. Defendant was enjoined from discriminating or retaliating in violation of the ADA, and required to post a notice of non-discrimination and provide employment discrimination training to its employees.
