The Chicago District Office of the EEOC brought this suit against Exelon Generation Co., L.L.C., who own and operate a nuclear power plant in Illinois, in September of 2005 in the U.S. District Court for the Northern District of Illinois. The suit alleged failure to reasonably accommodate, disciplining, and terminating a disabled employee in violation of the Americans with Disabilities Act. The suit was filed on September 30, 2005 and on the same day the parties moved for the entry of a consent decree. The decree was signed on October 5, 2005.
The consent decree included both monetary and injunctive relief. The complainant was to receive $60,000 and her attorneys were to receive $25,000. The injunctive relief requires the defendant to adopt an anti-discrimination policy, distribute the policy, post notice, train all managers and supervisors and medical personnel, and report on compliance and all complaints of disability discrimination every six months.
The decree was entered in 2005 and scheduled to last until 2007. No further docket entries exist, so the case is closed.
