On September 28, 2004, the Equal Employment Opportunity Commission (EEOC) filed this lawsuit against G. A. Hofler Construction in the United States District Court for the Eastern District of Virginia, Norfolk. The complaint was filed on behalf of a female employee under Title VII, 42 U.S.C. § 2000e. The female employee claimed that she had suffered job discrimination on the basis of sex.

On August 9, 2005, the EEOC filed a motion for default against defendant G.A. Hofler Construction, LLC. On November 14, 2005, proceedings were held before Judge Henry C. Morgan concerning the motion for default. On January 31, 2006, an order was issued by the court advising the EEOC that the Motion for Default had not been amended, and it advised that the EEOC had not provided sufficient evidence that the Plaintiff delivered notice of the November 14 hearing to the defendant.

Due to the above procedural issues, Judge Morgan dismissed the Plaintiff’s action without prejudice on January 31st, 2006.
