Case Summary

The EEOC's St. Louis and Kansas City offices filed this suit in the United States District Court for the Western District of Missouri, Southwestern Division on January 29, 2003. The suit alleged that defendant May's Drug Stores, Inc. violated Title VII by subjecting the female complainant to sexual harassment that resulted in her constructive discharge. After filing and intervention by the complainant, the case progressed smoothly through discovery. Then, after the trial date was postponed once, a settlement decree was entered on March 26, 2004.

In the settlement decree the defendant agreed to pay the complainant $75,000. $59,000 constituted punitive damages, $1,000 was for back pay, and $15,000 went towards the complainant's attorney's fees. The defendant also agreed to conduct training, report to the EEOC future complaints about a specific individual, and submit to EEOC inspection.
