The St. Louis District Office of the EEOC brought this suit against Quick Stop, L.L.C, in July of 2002, in the U.S. District Court for the Eastern District of Missouri. The suit alleged that the defendant discriminated against the complainant, in violation of the Americans with Disabilities Act, when they fired her due to her physical disability. The suit's only major motion was a motion for a protective order filed by the defendant that was subsequently denied. On March 20, 2003, three months after the jury trial date was set, the consent decree was signed by the judge.
The consent decree included both injunctive and monetary relief. The defendants were prohibited from discriminating or retaliating in violation of the Americans with Disabilities Act. They also had to post notice of the suit and distribute the rights of employees under the ADA to each manager and have each employee sign it. The monetary relief was a total of $20,000 to the complainant, $5,000 of which represented back pay and the remaining $15,000 was for other damages.
