The Dallas and Oklahoma City offices of the EEOC brought this suit against Voss Electric Company, doing business as Voss Lighting, in the United States District Court for the Western District of Oklahoma in January 2002. The complainants brought a separate suit (5:02-cv-00100-C) against the defendants in January 2002. The cases were consolidated in March 2002 and the EEOC's case was designated the lead case. Little litigation activity occurred in either case prior to consolidation. Subsequent to consolidation, several discovery motions by the defendant were granted, a settlement conference was held, and the defendant's motion for summary judgment was granted in part and denied in part. The cases were settled by consent decree in March 2003.
The three-year consent decree, containing anti-retaliation and anti-discrimination clauses, required the defendant to post notice of its anti-discrimination policy, provide annual training for two years to all its employees, report compliance with provisions of the consent decree to the EEOC, and pay the complainant $91,250.
