In September 2001, the EEOC district office in Charlotte, North Carolina brought this action against Nutricia Manufacturing USA, Inc, doing business as General Nutrition Products, in the U.S. District Court of the District of South Carolina. The EEOC alleged that the defendant violated Title VII of the Civil Rights Act of 1964 by discriminating on the basis of race.
A consent decree was entered in April 2002. The parties agreed that the defendant would refrain from retaliating and discriminating on the basis of race, pay the complainant $22,500, provide EEO training, post an EEO notice, and submit two complaint reports to the EEOC. No fees or costs were awarded. The terms of the agreement ran for eighteen months.
