In August 1997, the Memphis District Office of the EEOC brought this suit against T.F., Inc., formerly known as Taylor Forge International, Inc., in the U.S. District Court for the Western District of Tennessee. We do not have a copy of the complaint; therefore, the exact allegations involved are unknown. According to the consent decree, the complaint alleged that the defendant discriminated against the charging party, an applicant with epilepsy, by failing to hire him because of his disability in violation of the Americans with Disabilities Act of 1990 (the "ADA") and Title VII of the Civil Rights Act of 1964. After a few scheduling orders, the parties settled through a consent decree in January 1998.

The decree contained non-discrimination and non-retaliation clauses and required the defendant to: continue to post the notice required by the ADA and pay the charging party $17,000.
