The Cleveland office of the EEOC brought this suit against Royal Chemical Company, Ltd. in the U.S. District Court for the District of Ohio in December 2002. The complaint alleged that the defendant caused a racially hostile work environment, subjecting African American employees to different terms and conditions of employment due to their race in violation of Title VII of the Civil Rights Act of 1964. This case was noted as related to the complainant's private suit in February 2003. The parties engaged in settlement conferences with a magistrate judge resulting in a settlement in April 2004. A consent decree was entered in September 2004. The consent decree required the defendant to pay $125,000 in non-pecuniary compensatory damages to six employees; post notice; provide Title VII training for all employees; develop an anti-discrimination policy; and send quarterly reports of complaints to the EEOC for two years.
