The EEOC's Seattle district office sued Kimball International, Inc., d/b/a Flexcel on September 14, 2005 in the U.S. District Court for the District of Idaho. The EEOC's complaint alleged that the defendant violated the Age Discrimination in Employment Act when it discriminated based on age by terminating the employment of one of its elderly employees. The defendant filed a motion for summary judgment on June 26, 2006, which was granted on February 1, 2007. The EEOC filed an appeal in March 2007, the resolution of which is currently pending.
