The EEOC's Chicago district office sued First Health Group Corporation, on November 10, 2004 in the U.S. District Court for the Northern District of Illinois. The EEOC's complaint alleged that the defendant violated the Age Discrimination in Employment Act when it discriminated based on age by retaliating against an employee for filing a previously resolved complaint with the EEOC. The parties entered into a consent decree on November 10, 2005, which stipulated that the defendant would pay the complainant $122,500 in damages, post a notice of compliance with the ADEA, provide anti-retaliation training to its managers and HR personnel, distribute its non-retaliation policy, maintain records of discrimination, report complaints of discrimination to the EEOC semiannually, and allow the EEOC access to its premises to interview employees and copy documents.
The decree was entered in 2005 and scheduled to last until 2007. No further docket entries exist, so the case is closed.
