The EEOC's St. Louis office filed this suit in the U.S. District Court for the Eastern District of Missouri, St. Louis Division on July 19, 2001. The case was quickly transferred to the Hannibal Division. The suit alleged that American Cyanamid Company, which was subsequently purchased by BASF, withdrew job offers to two potential employees because they had diabetes, in violation of the Americans with Disabilities Act. The dispute settled by consent decree on November 20, 2002, soon after defendant's motion for summary judgment was denied. The charging parties were awarded approximately $75,000. BASF agreed to place the complainants in the job they were originally hired for. BASF also agree to pay monetary damages. Finally, BASF agreed to report to the EEOC any future complaints involving similar circumstances and allow the EEOC to inspect the premises yearly.
