In May 1997, the EEOC district office in Baltimore, Maryland brought this action against Downey Communications, Inc. and Marketing & Management Information, Inc. in the U.S. District Court for the District of Maryland. Although the complaint is not currently available, the docket shows that a female complainant intervened in the suit. There were several EEOC and defense discovery motions granted and denied throughout the litigation. However, the EEOC and the plaintiff intervenor managed to win motions for partial summary judgment in August 1998. After an unsuccessful defense motion for summary judgment, the parties settled and a settlement agreement was entered into in January 1999. No settlement documentation is currently available.
