EEOC's Detroit, MI office filed this sex discrimination lawsuit against the defendant, Metro Specialties, Inc. in the United States District Court for the Eastern District of Michigan (Detroit) on 06/24/2005. EEOC alleged that the defendant failed to prevent and correct sexually hostile environment suffered by a former female employee at its Monroe, MI facility, which caused the constructive discharge of the employee. Supervisors and colleagues of the employee engaged in sexually unwelcome comments and behaviors to the employee. The employee intervened in the lawsuit and sought compensatory damages.

District judge Bernard A. Friedman presided settlement conferences on two consecutive days and the parties settled on the second day. The parties had earlier been referred to mediation but the docket did not record any information relating to the mediation. The district court dismissed the case on 11/20/2006 when the parties placed their settlement on the record and a consent decree was entered as the final judgment on 01/23/2007.

Under the two-year consent decree, the defendant agreed to pay $56,000 to the individual complainant as compensatory damages. The defendant also agreed to reinstate the complainant with full seniority, including hiring an industrial psychologist to meet with the complainant and defendant's personnel as part of the reinstatement process. The defendant would also provide neutral reference for the complainant. Additionally, the defendant was required to post notice of EEO policies and provide training to all its managers and supervisors. The docket sheet does not show any further enforcement; the case was presumably closed in 2009.
