The New York District Office of the EEOC brought this action in the U.S. District Court for the Eastern District of New York, against North-Shore Long Jewish Health Systems, Inc. The complaint, filed in June 2005, alleged disability discrimination in violation of the Americans with Disabilities Act of 1990 (ADA); specifically that Defendant had disclosed to the charging party's co-workers, that he was receiving psychiatric treatment, causing the charging party to be harassed by his co-workers. The charging party intervened in September 2005, additionally alleging a violation of the Family and Medical Leave Act, and was allowed to proceed anonymously.
In January 2006 the case was referred to mediation and in June 2006 the parties settled. The consent decree prohibited Defendant from discriminating based on disability and required Defendant to pay $64,000 to the charging party, provide one hour of anti-discrimination training to its employees yearly, post and distribute a notice of non-discrimination, amend its non-discrimination policy and advise its new employees of their
right to confidentiality regarding their medical information under the ADA. The settlement term was three years. The docket sheet does not show any further enforcement; the case was presumably closed in 2009.
