The San Antonio Office of the EEOC brought this action in the U.S. District Court for the Western District of Texas, against M&S Imaging Partners, LLP. The complaint, filed in July 2003, alleged race discrimination in violation of Title VII of the Civil Rights Act of 1964; specifically that Defendant failed to hire the charging party because of her race (Black). In November 2003 the parties filed a joint motion to enter a consent decree, and it was entered the next day.
The decree, which was valid for 3 years, prohibited Defendant from discriminating against employees on the basis of race and required Defendant to pay the charging party $16,000 and post a notice regarding its non-discrimination policy. Defendant was also required not to mention the case when discussing the charging party's job performance with prospective employers.
