The Miami district office of the EEOC brought this suit against Lausell, Inc., a Puerto Rico corporation, in September 2006, in the U.S. District Court for the District of Puerto Rico. The complaint alleged that Lausell had refused to make reasonable accommodations for an employee's diabetes, in violation of the Americans with Disabilities Act, and that Lausell fired the employee due to this disability. In February 2008, the parties settled the case by entry of a consent decree.
The decree contained non-discrimination and non-retaliation clauses. It also required the posting and distribution of a non-discrimination policy and annual training for employees. The decree, effective for three years, also had record-keeping provisions and required Lausell to annually report disability discrimination complaints. Additionally, Lausell agreed to pay $74,500 to the complainant. The decree was to last for three years. The docket sheet doesn't show any further enforcement took place; the case was presumably closed in 2011.
