In September 1997, the Miami District Office of the EEOC filed this suit against Key Largo Group, Inc., formerly known as Ocean Reef Club Inc., in the U.S. District Court for the Southern District of Florida. The complaint alleged that the defendant violated the Age Discrimination in Employment Act of 1967 ("ADEA") by terminating the three charging parties, employees in their late forties, and replacing them with younger individuals. In addition, the defendant failed to maintain personnel files and relevant documents as required by the ADEA. The defendant filed a motion to dismiss in February 1998 which was denied in June 1998. In February 1999, the defendant then filed a motion for summary judgment, followed by a motion for partial summary judgment by the EEOC a month later. Neither motion was ever resolved, and the parties entered into a settlement agreement in March 2000.
The three-year agreement contained a non-discrimination clause and required the defendant to: post and distribute its anti-discrimination policy, provide annual EEO training for all of its employees, provide the parties with neutral employment references, report to the EEOC at specified intervals, and pay $30,000.
