The Memphis District Office of the EEOC brought this suit against Landers Auto Sales, Inc., in February of 1999, in the U.S. District Court for the Eastern District of Arkansas. The suit was based on a violation of the Americans with Disabilities Act ("ADA") and Title VII of the Civil Rights Act of 1964 by the defendant. In July the complainant, who intervened in the suit, was injured in a car accident, resulting in quadriplegia. The complainant required a wheel chair accessible office for him to resume his duties as a manager in a parts warehouse. The defendant refused to comply with this request and then retaliated against the complainant for complaining by demoting him. In August of 2000, a consent decree was ordered by the court.

The consent decree contained both monetary and injunctive relief. The monetary relief was in excess of $220,000. It consisted of a $160,000 check to be paid to the complainant along with his costs, which were $30,000. In addition, the defendant was required to hand over the title to the handicap van they were providing the complainant, which was valued at over $30,000. The injunctive relief contained a variety of items, including: expungment of complainant's record; a neutral reference in the future; removal of medical information from his record; ADA training for all supervisors at the Benton facility; making the Benton facility wheelchair accessible; and posting of Notice about the settlement.
