The New Orleans office of the EEOC brought this action in the U.S. District Court for the Eastern District of Louisiana, against Galliano Marine Service, d/b/a Edison Chouest Offshore, L.L.C. The complaint, filed in September 2000, alleged sex discrimination in violation of Title VII of the Civil Rights Act of 1964; specifically that Defendant had subjected charging party to a sexually hostile work environment. The charging party intervened in November 2000 and in October 2001 the EEOC moved for partial summary judgment. The motion for partial summary judgment was never ruled on because the parties settled and a consent decree was signed by the judge in December 2001.
The decree, valid for 2 years, required Defendant to devise a workplace harassment and discrimination procedure so that individuals can make complaints while the ship is at sea, post a notice of non-discrimination at its facility, provide annual EEOC training to all employees, and comply with the prohibition against discrimination and retaliation under Title VII.
