On September 29, 2004, the Baltimore office of the Equal Employment Opportunity Commission filed a lawsuit under the Age Discrimination in Employment Act (ADEA) against Bankruptcy Authorities, Inc. and SNS Administrative Services LLC in the U.S. District Court for the District of Maryland. The EEOC alleged that the defendants had violated the complainant's rights by firing him on the basis of his age.
On December 10, 2004, the defendants filed a motion to dismiss, or in the alternative for summary judgment. On January 6, 2005, the district court denied those motions. On March 4, 2005, the parties reached a settlement agreement, which the court approved three days later. Under the terms of the agreement, the defendants were enjoined from discriminating against any employees on the basis of age. The defendant agreed to pay the complainant $15,000 in back pay. The defendants agreed to provide the complainant with a neutral work reference and to provide EEO training for all management and human resources employees within 60 days of the settlement agreement's being entered by the court. The defendants were required post notice of the EEO laws in their places of business and to forward a copy of the notice to the EEOC offices for their inspection and approval.
