In December 1998, the Birmingham office of the EEOC brought this suit against K-Mart Corporation in the U.S. District Court for the Northern District of Alabama. The complaint alleged that the defendant discriminated against the claimant by not providing the claimant with reasonable accommodation of her religion in violation of Title VII of the Civil Rights Act of 1964. The defendant moved for summary judgment, which was not resolved because the parties reached a settlement by entry of a consent decree in February 2000.
The two year consent decree included an anti-discrimination and anti-retaliation provision; adoption of a policy prohibiting discrimination in the workplace; training for managers and supervisors; posting of notice; and a neutral reference for the claimant.
