In November 1998, the Memphis and Little Rock offices of the EEOC brought this suit against McKnight Plywood, Inc. in the U.S. District Court for the Eastern District of Arkansas. The complaint alleged that the defendant failed to reasonably accommodate and discharged the claimant because of his disability (alcoholism) in violation of the Americans with Disabilities Act. The defendant moved to dismiss because it was engaged in bankruptcy proceedings, which was denied. The parties settled by entry of a consent decree in March 2000.
The two year consent decree required the defendant to reasonably accommodate employees with disabilities; refrain from discrimination and retaliation because of a disability; provide training on the requirements of the ADA to all management employees; distribute its ADA policy to all employees; post notice pursuant to the ADA; and give the claimant an unsecured bankruptcy claim against the defendant in the amount of $5000.
