In February 2001, the EEOC district office in Miami, Florida brought this suit against Fugleberg Koch Architects, Inc. in the U.S. District Court for the Middle District of Florida. A former employee alleged discrimination and retaliation based on his religion, Jewish, in violation of Title VII of the Civil Rights Act of 1964. Specifically, the complaints alleged that the employee (who intervened in the suit as a plaintiff) was subjected to racial slurs, jokes, derogatory questions, derogatory comments, and drawing of swastikas at work. After the parties attended mediation in March 2002, a consent decree was entered in April of that same year.
In the consent decree, the parties agreed that the defendant would pay the former employee $55,728 in compensatory damages, pay $44,272 for attorney's fees, refrain from retaliating or discriminating based on religion, post and distribute EEO notices, provide all its employees with EEO training, allow the EEOC to randomly interview staff for compliance, submit semiannual reports to to the EEOC, and appoint the HR Director to coordinate all compliance measures. The terms of the decree ran for three years.
