In August 2003, the Phoenix and Albuquerque offices of the EEOC brought this ADEA suit against Alliance Residential LLC (d/b/a Alliance Residential Management d/b/a Alliance Residential Company) in the U.S. District Court for the District of New Mexico. The complaint alleged that the defendant failed to offer the charging party, a 74 year old female part-time employee, a full-time position and discharged her because of her age. On the same day as the termination, the defendant hired a significantly younger, less experienced employee to replace charging party. The case settled by entry of a consent decree in April 2004.
