In September 2002, the Atlanta office of the EEOC brought this Title VII suit against Bankhead Contracting in the U.S. District Court for the Northern District of Georgia. The complaint alleged that the defendant discriminated and retaliated against the charging party because of her sex. The case settled by entry of a consent decree in April 2003.
The two year decree contained a non-discrimination and non retaliation provision, posting of notice and instruction to management regarding the decree, manager training, bi-annual reports to the EEOC of any complaints filed, $25,000 payment to the charging party, neutral references for the charging party, and a disciplinary policy on retaliation.
