The Richmond, VA office of the EEOC brought this ADA suit against Quality Foods Cooperative, Inc. in September 2003, in the U.S. District Court for the Western District of Virginia. The complaint alleged that the defendant failed to provide a reasonable accommodation to the charging party, leading to the charging party's discharge. The parties came to a settlement through mediation, and the court entered a consent decree in June 2004.
The one year consent decree called for the defendant to expunge from the charging party's record anything about the discrimination claim, pay the charging party $13,500 (back pay and compensatory damages), comply with applicable employment laws, and adopt policies and procedures regarding the ADA, institute training, and post a notice of employee rights under the ADA.
