The EEOC's Cleveland district office sued the International Brotherhood of Electrical Workers Local No. 998, a national union, on July 25, 2002 in the U.S. District Court for the Northern District of Ohio. The EEOC's complaint alleged that the IBEW violated Title VII when it discriminated against the intervenor, who intervened in May 2003, based on sex (female). Specifically, the IBEW created a sexually harassing atmosphere, failed to take corrective action in response to the intervenor's com…

The EEOC's Cleveland district office sued the International Brotherhood of Electrical Workers Local No. 998, a national union, on July 25, 2002 in the U.S. District Court for the Northern District of Ohio. The EEOC's complaint alleged that the IBEW violated Title VII when it discriminated against the intervenor, who intervened in May 2003, based on sex (female). Specifically, the IBEW created a sexually harassing atmosphere, failed to take corrective action in response to the intervenor's complaint about her working conditions in retaliation for her complaint. In November 2004, the court dismissed two of the intervenor's causes of action because the statute of limitations had run before she filed suit. In late November 2004, the IBEW filed a motion for summary judgment, which was granted in February 2005, as it was not responsible for the local union's harassment. Judge James Carr presided over numerous management/status conferences in the case.

Finally, the parties settled out of court and the court entered a consent decree between the parties on January 11, 2006 which stipulated that the local IBEW was required to pay $5,500 in damages to the intervenor, post a notice of compliance with Title VII, and provide all of its employees with Title VII compliance training. The decree was to last for two years. The docket sheet doesn't show any further enforcement took place; the case was presumably closed in 2008.
