This suit was filed by the EEOC's Seattle office in September 2004 against Hollywood Entertainment Corporation, in the U.S. District Court for the District of Idaho. The complaint alleged that the charging party had been refused a promotion and constructively discharged on the basis of her disability, in violation of the Americans with Disabilities Act. The charging party attempted to intervene in March 2005 and at the same time filed a motion to consolidate this case with her private lawsuit (4:04-cv-00613-BLW). The consolidation was granted in May 2005 and the EEOC case became the lead case. The case was settled by entry of a consent decree in March 2006.
The consent decree, which was valid for two years, required Hollywood not to discriminate or retaliate, and provided for monetary relief in the amount of $70,000. The decree also required Hollywood to distribute an anti-discrimination policy, post an EEO notice, and institute yearly anti-discrimination training. Additionally, the decree also included provisions for annual reporting to the EEOC on discrimination complaints and compliance with the consent decree. The defendant was also required to expunge the charging party's employee file. The settlement term was 2 years. The docket sheet does not show any further enforcement; the case was presumably closed in 2008.
