The St. Louis office of the EEOC brought this EPA suit against Fort Osage School District in July 2004, in the U.S. District Court for the Western District of Missouri. The complaint alleges that the defendant paid the charging party, a female assistant superintendent, less money than male assistant superintendents performing substantially equal jobs. The charging party intervened in the suit in December 2004. After a period marked by a substantial amount of discovery motions, the parties came to an agreement and the EEOC dismissed its case.
The Settlement Agreement called for the defendant to pay the charging party $3,000 as a wage payment and $86,795.42 in reasonable attorneys' fees. The defendant also agreed to modify its Policy GCBA Professional Staff Salary Schedules, give annual reports to the EEOC of the salaries, names and genders of assistant superintendents, and comply with the EPA. In exchange, the charging party agreed to refrain from seeking employment with the District or its Board of Education.
