The Kansas City office of the EEOC brought this action in the U.S. District Court for the Western District of Missouri, against Praxair Surface Technologies, INC. The complaint, filed in January 2000, alleged sex discrimination in violation of Title VII of the Civil Rights Act of 1964. Specifically, the complaint alleged that Defendant failed to promote the charging party to a position, for which she was qualified, because of her sex. In February 2001, Defendant moved for summary judgment, but in March 2001, the motion was denied.
In May 2001, the parties settled and agreed to a consent decree. The decree, which was good for 2 years, included non-discrimination and non-retaliation provisions, and required Defendant to pay a total of $30,200. Defendant also agreed to post copies of a non-discrimination notice in locations publicly visible to all employees, and to offer leadership training on an annual basis during the fourth quarter of 2001 and 2002. Additionally, Defendant would, within thirty days of a complaint of sex discrimination made by any employee, provide written notification to the EEOC.
