The Baltimore district office of the EEOC brought this suit against McCrea Equipment Company, Inc., in September 2006, in the District Court of Maryland. The complaint alleged that two female employees were subjected to sexual harassment by a Systems Administrator and retaliation by unnamed employees for complaining to management. The hostile work environment created by the sexual harassment and retaliation led to the constructive discharge of the employees. One employee was subjected to racial and retaliatory harassment. The other employee was involuntarily transferred to another facility with a longer commute and was harassed by employees at the other facility.
A few weeks after the Defendant answered the EEOC's complaint, the parties began settlement proceedings. A consent decree was entered into in July 2007. The consent decree required the Defendant to implement a revised sexual harassment policy, which included using a human resources official as a recipient and investigator of harassment complaints. Two hours of training of managers and hour of training of all other employees was required to be conducted by an outside trainer or attorney. Notice of the Defendant's sexual harassment policy was required to be posted. The defendant agreed to pay a total of $110,000 to the two former employees. The decree was to last for two years. The docket sheet doesn't show any further enforcement took place; the case was presumably closed in 2009.
