In January 2000, the U.S. Department of Justice [DOJ] commenced an investigation pursuant to 42 U.S.C. § 14141 of the Mount Prospect Police Department [MPPD]. The investigation was prompted by a letter sent to the DOJ by United States District Judge Ruben Castillo, in which he referred allegations of racial profiling of Hispanics raised during the employment discrimination trial of Martinez v. Village of Mount Prospect, 92 F. Supp.2d 780 (N.D.Ill. 2000). Following the investigation, the DOJ and the MPPD entered into a Memorandum of Agreement on January 22, 2003, which set forth changes to be implemented to certain MPPD police and procedures which included:
• creation of a written policy prohibiting discrimination in policing, including traffic stops
• documentation of various information (including race) for all traffic stops
• improved training and officer supervision
• publication of semi-annual reports that provided statistical and summary information on traffic stops and complaint investigations.
The agreement was to terminate five years after its effective date, unless modified by the parties. As of the date of this summary, it is not known if the agreement has been terminated.
