On February 4, 1988, the United States Department of Justice Civil Rights Division notified the Governor of New York that it intended to investigate conditions at Creedmoor Psychiatric Center pursuant to authority granted by the Civil Rights of Institutionalized Persons Act (CRIPA), 42 U.S.C. § 1997 et seq. Sometime that same year, the United States filed a lawsuit in the United States District Court for the Eastern District of New York charging that the State of New York, the Governor of New York, the New York State Office of Mental Health, and Creedmoor Psychiatric Center were obstructing the Creedmoor CRIPA investigation. Specifically, the United States claimed that the defendants refused to grant investigators access to Creedmoor unless the United States signed a proposed consent decree in United States v. State of New York, a lawsuit dealing with conditions at the Buffalo Psychiatric Center. The plaintiffs asked the court to enter an injunction to force New York to give the United States access to Creedmoor's facilities, staff, patients, and records and enter other equitable relief as appropriate.
We have no information on what occurred in this lawsuit after the Complaint was filed.
