On August 11, 1994, juvenile plaintiffs filed a § 1983 civil rights class action suit in the U.S. District Court for the Western District of Washington (Tacoma), challenging conditions of confinement at the Green Hill School (GHS). Plaintiffs were represented by attorneys for the National Center for Youth Law Columbia Legal Services and sought declaratory and injunctive relief.

Plaintiffs amended their Complaint on August 17, 1994. Defendants moved to dismiss, which was denied by the District Court (Judge Robert J. Bryan) on November 8, 1994.

The case was certified as a class action by a Stipulated Order filed on September 30, 1994. The class consisted of all juveniles currently or in the future incarcerated at Green Hill School (GHS).

On December 6, 1994, the District Court granted in part plaintiffs' motion for a Preliminary Injunction regarding defendants' use of pepper spray at GHS.

On September 11, 1995 District Court (Judge Robert J. Bryan) approved the agreed Stipulation and Judgment, which called for numerous reforms at GHS in the following areas: renovations to the physical plant; use of pepper spray and mechanical restrains; disciplinary procedures; education and rehabilitative services. The Stipulation called for appointment of a monitor to oversee the implementation process for a period of four years. The parties agreed to try the remaining claims relating to treatment and health care. On November 5, 1996, the District Court entered an Order approving settlement of the remaining claims. The monitoring period followed and the parties continued to litigate the issue of attorneys' fees and costs.

On August 15, 2001, the District Court (Judge Robert J. Bryan) entered a Stipulation in which the parties agreed to settlement of plaintiffs' claim for attorneys' fees and costs for $250,000.00. The case was then dismissed and closed. No other case activity is noted after that date.
