On December 10, 1986, black registered voters in Mississippi filed a class action lawsuit under Section 2 of the Voting Rights Act and 42 USC 1983 in the U.S. District Court for the Southern District of Mississippi. Plaintiffs, represented by private counsel, sought declaratory and injunctive relief, alleging that a Mississippi statute which required that school board referenda must pass by a 60% majority, rather than a simple majority vote, abridged the voting rights of black voters in violation of the Fourteenth and Fifteenth Amendments.
This action was originally filed challenging the operation of the Mississippi law, Miss. Code Ann. 57-39-17, to the Jackson Municipal Separate School District. Thereafter, in 1991, another suit was filed (Robinson v. Stewart, 91-0687) challenging the application of the same law state-wide. On January 29, 1992, the court (Judge Tom S. Lee) consolidated the two cases.
Following a non-jury trial on August 17, 1993, the court (Judge Lee) issued judgment in favor of the defendants and dismissed the case. Armstrong v. Allain, 893 F.Supp. 1320 (S.D. Miss. 1994). Specifically, the court found that the plaintiffs had failed to establish that any racially polarized voting was motivated by race or that Mississippi's statute was motivated by racial considerations.
The plaintiffs appealed. On July 13, 1995, the Fifth Circuit Court of Appeals affirmed without opinion. Armstrong v. Fordice, 62 F.3d 396 (5th Cir. 1995).
