This class action lawsuit, brought in 2021 by persons incarcerated or detained in Hawai'i correctional facilities, alleged that the conditions in the state's jails and prisons during the COVID-19 pandemic had contributed to multiple COVID-19 outbreaks and sought implementation of health and safety protocols.

On June 8, 2021, this case was removed from Hawaii’s First Circuit Court to the U.S. District Court for the District of Hawaii. On June 9, plaintiffs filed their first amended class action complaint asking for injunctive relief, temporary restraining order, and declaratory judgment and on June 22, they filed a motion for class certification. 

A hearing was held on these motions on July 8, 2021, in front of Judge Jill A. Otake, and on July 13, 2021, the court issued an order granting plaintiffs' motion for provisional class certification and granting in part and denying in part the preliminary injunction and temporary restraining order. The court refused to appoint a special master at the preliminary phase, but required defendants to adhere to the Hawai'i Department of Public Safety Pandemic Response Plan COVID-19.

Throughout August, Defendants attempted to amend the order, and the court received several letters and status reports on the COVID-19 outbreak within the prison system. On August 12, 2021, the court issued an order denying the defendant’s motion to modify the court order, and on August 16 defendants appealed (USCA Nos. 21-16324 and  21-16364) and filed a motion to stay the court’s injunction pending that appeal on August 17. That appeal was soon dismissed, however, as by the end of August the parties had negotiated a tentative settlement agreement. Defendants dismissed their appeals a month later on September 16 and the court terminated defendants' motion to stay the court's injunction pending appeal as moot on September 21. 

Beginning in August, the parties held ongoing settlement conferences, and on September 3, 2021, the parties filed a joint motion for preliminary approval of their settlement agreement, asking the court to schedule a fairness hearing, and filing a joint motion for an order approving notice and directing notice to the class. On September 9, the court issued an order granting these joint motions.

Settlement negotiations concerning attorney's fees remained ongoing into September, and on September 28, Judge Jill A. Otake issued a stipulation and order that Defendants comply with the terms of the settlement agreement until the court had made a final ruling on that agreement. On October 7, 2021, plaintiffs filed a motion for approval of attorneys’ fees and costs, and on October 8, the parties issued a joint motion for Settlement Approval. 

The settlement agreement provided for Defendants to implement the Pandemic Response Plan, implement an independent Agreement Monitoring Panel which would advise and provide oversight of Defendants' implementation of the Pandemic Response Plan. The agreement also required Defendants to implement quarantine and isolation procedures for individuals newly admitted to facilities, to require staff to be vaccinated and to provide vaccines to individuals who were detained or incarcerated, and to implement extra sanitation procedures. The settlement agreement was set to remain in place until January 31, 2022, with the possibility of extension until March 31, 2022. 

Throughout October, the court coordinated different requests from class members who wished to appear and in some cases speak at the final fairness hearing. That hearing was then held in front of Judge Jill A. Otake on November 8, 2021, during which the court conducted a final fairness hearing on the settlement agreement agreed to by both parties and heard arguments on the plaintiff's motion for approval of attorneys fees and costs. On November 10, the court issued an order granting the joint motion for final settlement approval and the plaintiff’s motion for approval of attorney’s frees and costs settlement agreement.

EO: On 8/8/21, Defendant filed a 51 Second Motion to Amend/Correct Preliminary Injunction, the second such request in just over one week's time. Defendant admits that he did not comply with Local Rule 7.8 but believes that he need not comply because his Motion is connected to Plaintiffs motion for preliminary injunction. He is mistaken. Local Rule 7.8 does not exempt these motions filed by Defendant. The Court previously waived Local Rule 7.8's seven-day requirement because the parties conferred; it did not authorize the parties to dispense of the requirement altogether.
