This is a case about safe voting access during the COVID-19 pandemic. On July 16, 2020, Mi Familia Vota, Texas State Conference of NAACP, and individual registered voters filed this lawsuit in the U.S. District Court for the Western District of Texas. The plaintiffs sued the Governor and the Secretary of State of Texas under the First Amendment, the Equal Protection and Due Process Clauses of the Fourteenth Amendment, the Fifteenth Amendment, and Section Two of the Voting Rights Act. Represented by Free Speech for People and a private firm, the plaintiffs alleged that under pandemic conditions, Texas’ voting infrastructure unlawfully burdened Texans’ right to vote, and they sought an injunction requiring defendants to modify in-person voting procedures to, among other things, expand early voting and mobile voting, open additional polling places and add hours, require masking in polling places, provide protective gloves and masks for poll workers, and other measures to ensure safe access to voting during a pandemic. They challenged, in part, Exemption 8 of Governor Abbott’s Executive Order GA-29, which exempted those who are “voting, assisting a voter, serving as a poll watcher, or actively administering an election” from compliance with the statewide mask mandate.  The case was assigned to Judge Jason K. Pulliam.

On August 10 and 12, 2020, defendants filed motions to dismiss, and on August 26, 2020, plaintiffs filed a motion for a preliminary injunction.  On September 7, 2020, the district court granted the defendants' motions to dismiss for lack of subject matter jurisdiction, holding that the lawsuit raised nonjusticiable political questions. 484 F.Supp.3d 435. Since the motions to dismiss were granted, the plaintiffs’ motion for preliminary injunction was denied as moot. On September 11, 2020, the plaintiffs appealed. On October 16, 2020, the U.S. Court of Appeals for the Fifth Circuit reversed in part and affirmed in part, holding that most claims were properly dismissed but that the district court could find that Exemption 8 violated Section Two of the Voting Rights Act (VRA) if it concluded this redressed the alleged injuries, since the VRA claim was not a political question and was not barred by sovereign immunity. However, it reasoned that it would not be appropriate to remand the VRA claim for plenary consideration, since the election was ongoing.  977 F.3d 461.

On October 20, 2020, the plaintiffs filed a motion for a temporary restraining order and a preliminary injunction excising the mask mandate exemption from the Governor’s executive order. On October 27, 2020, the district court granted the plaintiffs’ request for a preliminary injunction in part, reasoning that the plaintiffs had shown a substantial likelihood of success on the merits of their claim that Exemption 8 violated Section 2 of the VRA in light of the health risks it posed, the social conditions of the pandemic, and the resultant deterrent effect on Black and Latino voters. The district court, therefore, invalidated and voided the exemption. 497 F.Supp.3d 195. On October 27, 2020, the defendants appealed the preliminary injunction ruling. On October 28, 2020, the Fifth Circuit stayed the appellant’s opposed motion for stay pending appeal. 2020 WL 6334374. On October 30, 2020, the Fifth Circuit stayed the injunction because the changes in election rules at this point in the election would alter the status quo. 834 Fed.Appx. 860. On November 23, 2020, the plaintiffs filed a notice of voluntary dismissal in the district court. On December 22, 2020, the appellate court vacated the district court’s opinion granting a preliminary injunction and granted the defendants’ motion to remand to the district court to dismiss for lack of subject matter jurisdiction. Per the appellate court’s order, the district court dismissed the case on January 5, 2021, because the election was over and the claims were moot.
